Welcome to ELEM Trade (“we,” “us,” or “our”). By accessing or using our website (www.elemtrade.com) or any of our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our services.
You must be at least 18 years old or a duly authorized representative of a legal entity to place orders with ELEM Trade.
All product orders are subject to availability. Pricing is subject to change without prior notice. Orders will be processed only after full payment has been received and verified.
Delivery timelines provided are estimates only and not guaranteed. ELEM Trade is not responsible for delays, damages, or losses caused by third-party shipping or freight carriers. For hazardous or regulated materials, it is the buyer’s responsibility to ensure compliance with all applicable local, state, and federal laws. Proper documentation may be required.
Due to safety and compliance regulations, all chemical sales are final and non-returnable, except in cases of verified defect or shipping error. Refunds or replacements are handled on a case-by-case basis, at our sole discretion.
All content on this website—including but not limited to logos, trademarks, text, graphics, and images—is the property of ELEM Trade and is protected by applicable copyright and intellectual property laws. Unauthorized use is strictly prohibited.
ELEM Trade reserves the right to suspend or terminate user access for violations of these Terms & Conditions or for any misuse of our services.
These Terms & Conditions are governed by and construed following the laws of the State of New York, United States, without regard to its conflict of law principles.

Any specifications, product requirements, or proprietary information shared by clients during the sourcing or quotation process will be treated as confidential. ELEM Trade will not disclose or share such information with third parties without prior written consent.
Quotes provided by ELEM Trade are valid for a limited time (typically 7–15 business days) unless stated otherwise. Custom sourcing requests may require additional lead time, documentation, or regulatory review depending on product category, origin, and port of delivery.
For shipments requiring import or port-to-port delivery services, ELEM Trade shall coordinate logistics and documentation to the extent specified in the agreed terms (e.g., FOB, CIF, DDP). Title and risk of goods typically transfer upon delivery to the named port or handoff to the carrier, unless otherwise agreed in writing.
ELEM Trade shall not be held liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, port closures, labor disputes, government actions, supply chain interruptions, or global pandemics.
Buyers are responsible for providing valid tax exemption or resale certificates where applicable. Compliance with any regulatory requirements related to chemical import, storage, usage, or distribution lies solely with the buyer unless explicitly handled under a written agreement with ELEM Trade.
